What is E-Verify? E-Verify is a federal Web-based system that electronically verifies the employment eligibility of newly hired employees.
What are the rules for E-Verify?
Employers participating in E-Verify MUST NOT:
- Use E-Verify to pre-screen an applicant for employment.
- Specify or request which Form I-9 documentation an employee must use, except to specify that any Form I-9 List B document the employee chooses to present must contain a photo.
Who is exempt from E-Verify?
Under the FAR, to be exempt from E-Verify, the employee must meet both of two regulatory criteria: (1) Normally performs support work, such as indirect or overhead functions; and (2) Does not perform any substantial duties applicable to the contract.
Can you E-Verify without a Social Security number?
What should I do? A case cannot be created in E-Verify without an SSN. If a newly hired employee has applied for, but has not yet received his or her SSN (e.g., the employee is a newly arrived immigrant), attach an explanation to the employee’s Form I-9 and set it aside.

E-Verify will return a Tentative Non-Confirmation. When this happens, the employee must contest the results. When the employee fails or refuses to contest the results, E-Verify will indicate a Final Non-confirmation. The employer will then be bound by law to terminate the employee.
